Long-Stay Booking – Terms & Conditions (31+ Days)

These Terms & Conditions apply to all long-stay bookings of 31 consecutive days or more at our property located in Frankston South, Victoria. The full street address will be provided after payment is received.

By making a booking, paying any portion of the Booking Fee or Security Deposit (if required), or checking in, you agree to be bound by these Terms.

1. Booking & Occupancy Period

  • All bookings are for a fixed period of 31 consecutive days or more (the “Occupancy Period”).
  • This is a temporary accommodation arrangement, not a residential tenancy under the Residential Tenancies Act 1997 (Vic).
  • Early departure does not shorten the Occupancy Period. No refunds apply unless required by Victorian Consumer Law.

2. Payments

  • The Total Booking Fee must be paid in full before check-in.
  • A booking is confirmed only once cleared payment has been received in one of the accepted forms below.

Accepted payment methods

  • (a) Stripe (Credit/Debit Card)
    – Visa, Mastercard, American Express
    – You will receive a secure Stripe payment link
    – Booking is confirmed only after successful Stripe payment
  • (b) Bank Transfer
    Bank transfer details will be provided after your reservation request has been accepted.
    Booking is confirmed once funds are received.
  • (c) Other methods (if agreed)
    – PayID
    – International bank transfer (fees payable by guest)
  • Failure to pay by the required deadline may result in cancellation.

3. Security Deposit

  • Security Deposit may be required, based on guest numbers, booking duration, or risk considerations.
  • If collected, the deposit may be used to cover:
    • damage to property or furnishings;
    • missing items;
    • excess cleaning;
    • council or police penalties related to your stay;
    • late payments or unpaid charges;
    • breaches of these Terms.
  • Any deposit collected will be refunded within 7 days of departure, minus any deductions.

4. Maximum Occupancy & Visitors

  • Maximum overnight occupancy is 10 persons.
  • Visitors may attend during reasonable hours but may not stay overnight without prior written permission.
  • Parties, events, gatherings, and commercial activities are strictly prohibited.

5. Behaviour & Eviction

  • You may be evicted without refund if you or your visitors engage in:
    • illegal, unsafe, disruptive or threatening behaviour;
    • excessive noise;
    • damage to the property;
    • breaches of council bylaws;
    • abuse of neighbours or community members.
  • If eviction is required, you must vacate the property within 1 hour of being notified.
  • Any costs, penalties or damages arising from such behaviour are payable by you and may be deducted from the Security Deposit or charged separately.

6. Noise & Party Rules

  • No loud noise after 10:00pm.
  • No outdoor amplified music at any time.
  • No parties, gatherings, or functions.
  • Council/police fines are payable by the guest.

7. Smoking & Vaping

  • Indoor smoking or vaping is strictly prohibited.
  • Outdoor smoking may be permitted if pre-approved.
  • Cleaning fees apply for odours, residue, burns, or improper disposal.

8. Pets

  • Pets are only permitted with prior written approval.
  • You are responsible for all pet-related cleaning, noise, and damages.

9. Pool Use & Safety

  • Children must be supervised at all times.
  • No glass or sharp objects in the pool area.
  • Do not adjust or interfere with pool equipment.
  • Pool gate must remain closed and latched.

Pool Safety Notice: If you cannot see your child, you cannot supervise your child.

10. BBQ & Fire Safety

  • BBQ must not be left unattended.
  • Turn off gas bottle after use.
  • No candles, fire pits, or open flames without written permission.
  • Do not place hot coals or ashes in bins.

11. Garage & Parking

  • Parking for 3 vehicles total:
    • 2 cars in the garage; and
    • 1 car in the driveway.
  • Parking on lawns, nature strips or blocking neighbours is prohibited.

12. CCTV & Privacy (Audio + Video)

  • For security, insurance and property management purposes, the property is equipped with one external-only CCTV camera at the front door.
  • This camera records both video and audio in the external entry area.
  • The camera:
    • monitors only the front entry door and porch area;
    • does not record any internal areas;
    • operates continuously;
    • stores footage securely;
    • may be used to verify arrivals, departures, occupancy and security events.
  • By booking and staying at the property, you consent to the use of external audio and video CCTV recording.
  • Tampering with, disabling or obstructing the camera is strictly prohibited and may result in immediate eviction and charges for repair/replacement.

13. Utilities & Internet (Fair Use)

  • Water, electricity, gas (if applicable) and Wi-Fi are included under a fair-use policy.
  • Excessive or unreasonable usage may incur additional charges.
  • Internet must not be used for unlawful purposes.

14. Cleaning Obligations & Extra Cleaning Fees

  • Guests must keep the property clean during their stay and leave it in a tidy condition on departure.
  • Additional cleaning fees may apply for:
    • excessive rubbish;
    • unwashed dishes;
    • spills, stains or strong odours;
    • misuse of outdoor or pool areas;
    • unreasonable mess left behind.
  • These fees may be deducted from the Security Deposit or charged separately.

15. Damage Reporting Requirement

  • You must report any damage or breakage as soon as it occurs.
  • Failure to report damage may result in full repair or replacement costs being charged.

16. Check-In & Check-Out

  • Check-in: 3:00pm
  • Check-out: 10:00am
  • Early check-in or late check-out requires prior written approval and may incur a fee.

17. Cancellations & Refunds

  • Guest cancellations:
    – More than 30 days before check-in = full refund
    – 30 days or less before check-in = 50% refund
  • Owner cancellations:
    A full refund will be provided.

18. Access to the Property

  • We may enter with reasonable notice for urgent repairs, safety issues or necessary inspections.
  • In emergencies or suspected serious breaches, we may enter without notice.

19. Force Majeure (Unforeseen Events)

  • We are not liable for events outside our control including:
    • extreme weather;
    • natural disasters;
    • power outages;
    • essential service failures;
    • pandemics or government restrictions;
    • other events classified as force majeure.
  • Refunds in such events are at our discretion unless required by law.

20. Lost Keys & Lockout Fees

  • Lost keys, remotes or access devices will be charged at replacement cost.
  • Lockouts requiring staff attendance may incur a $200 fee.

21. Insurance Responsibility

  • Guests are strongly encouraged to hold travel insurance and/or contents insurance for personal belongings.
  • We are not responsible for loss, theft or damage to guest property.

22. Late Payment & Retention Rights

  • We may refuse check-in, delay key hand-over, or cancel the reservation if payment deadlines are not met.

23. Prohibited Items

  • Prohibited items include (without limitation):
    • fireworks;
    • candles or open flames;
    • drones;
    • weapons;
    • illegal substances;
    • generators;
    • dangerous chemicals.

24. Liability

  • You use the property (including pool and outdoor areas) at your own risk.
  • We are not liable for injury, loss, theft, or utility outages beyond our control.
  • Nothing in these Terms removes your rights under the Australian Consumer Law.

25. Governing Law

  • These Terms are governed by the laws of Victoria, Australia.
